Welcome to FantasyPulse! These Terms of Use ("Terms") govern your access to and use of the FantasyPulse website and mobile application (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1. Use of the Service

Eligibility: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
Account Registration: To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for any activities or actions under your account.
License to Use the Service: Subject to your compliance with these Terms, FantasyPulse grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.
Prohibited Conduct: You agree not to engage in any of the following prohibited activities:
- Violate any law, regulation, or these Terms;
- Infringe any intellectual property or other proprietary rights;
- Engage in any conduct that is fraudulent, deceptive, or misleading;
- Harass, abuse, or threaten any other user of the Service;
- Use the Service for any commercial purpose without FantasyPulse's prior written consent;
- Interfere with or disrupt the Service or servers or networks connected to the Service;
- Use any data mining, robots, or similar data gathering and extraction methods in connection with the Service.

2. User Content

User Content: The Service allows users to submit, post, and share content, such as text, images, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the Service.
License to User Content: By posting User Content to the Service, you grant FantasyPulse a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
User Content Guidelines: You agree not to post any User Content that:
- Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
- Infringes any patent, trademark, trade secret, copyright, or other intellectual property or proprietary rights of any party;
- Contains software viruses or any other computer codes, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
- Impersonates any person or entity, or falsely states or otherwise misrepresents your affiliation with a person or entity.
Monitoring User Content: FantasyPulse reserves the right, but is not obligated, to monitor and remove any User Content for any reason or no reason, including User Content that FantasyPulse believes violates these Terms.

3. Intellectual Property

Ownership: The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by FantasyPulse, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Trademarks: The FantasyPulse name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of FantasyPulse or its affiliates or licensors. You must not use such marks without the prior written permission of FantasyPulse.
Feedback: If you provide FantasyPulse with any feedback, suggestions, or ideas ("Feedback"), you hereby assign to FantasyPulse all rights in the Feedback and agree that FantasyPulse shall have the right to use such Feedback and related information in any manner it deems appropriate. FantasyPulse will treat any Feedback you provide as non-confidential and non-proprietary. You agree that you will not submit to FantasyPulse any information or ideas that you consider to be confidential or proprietary.

4. Termination

Termination by FantasyPulse: FantasyPulse may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under FantasyPulse's sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
Termination by You: If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Disclaimer of Warranties

No Warranties: The Service is provided on an "as is" and "as available" basis. FantasyPulse makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on or associated with the Service. FantasyPulse does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service or the server that makes it available are free of viruses or other harmful components.
Limitation of Liability: FantasyPulse will not be liable for any damages of any kind arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

6. Indemnification

Indemnification: You agree to indemnify, defend, and hold harmless FantasyPulse, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

7. Governing Law

Governing Law: These Terms and your use of the Service are governed by and construed in accordance with the laws of India, without giving effect to any choice or conflict of law provision or rule.
Dispute Resolution: Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration conducted in India. You and FantasyPulse agree to submit to the personal jurisdiction of the courts located within India for the purpose of litigating all such claims or disputes.

8. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and FantasyPulse regarding the use of the Service, superseding any prior agreements between you and FantasyPulse relating to your use of the Service.
Waiver and Severability: The failure of FantasyPulse to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
Amendments: FantasyPulse reserves the right to amend these Terms at any time and without notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
